Court Blocks Parliament's Ramaphosa Impeachment Push; Constitutional Challenge Stalls Proc

SOUTH AFRICAN COURT HALTS IMPEACHMENT PROCEEDINGS AGAINST RAMAPHOSA

A Western Cape High Court ruling on Friday handed President Cyril Ramaphosa a procedural shield against a parliamentary impeachment process, pausing public hearings while he challenges the constitutional validity of a 2022 report that concluded he “may have committed” serious violations and misconduct. Judge Andre le Grange issued an interim interdict barring the impeachment committee from advancing with public proceedings until the court determines the merits of Ramaphosa’s legal challenge.

The ruling is a concrete win for the president, who is fighting on more than one legal front at once. He is also awaiting the outcome of a separate court case examining findings from an independent panel on whether he has a case to answer over the underlying scandal.

That scandal, known as “Farmgate,” centers on approximately $580,000 in undeclared foreign currency found at Ramaphosa’s Phala Phala farmhouse in Limpopo province. The president has maintained the cash represented proceeds from the sale of buffaloes and has consistently denied wrongdoing. The funds surfaced after being reported stolen in 2020, and Ramaphosa has ruled out resignation despite the reputational damage the episode has caused.

The political fallout has been substantial. In late 2022, the controversy nearly cost Ramaphosa the leadership of the African National Congress, the country’s dominant political party. The broader corruption allegations surrounding the ANC contributed materially to the party’s loss of its parliamentary majority in May 2024, the most closely contested election in South Africa’s democratic history. The ANC currently holds approximately 40 percent of seats in the National Assembly and leads a coalition government.

Presidential spokesperson Vincent Magwenya responded to Friday’s ruling by stressing institutional deference. “The president reaffirms his respect of judicial independence and separation of powers enshrined in our Constitution,” Magwenya said. “The president will continue to cooperate with and abide by processes of accountability.”

By most political assessments, Ramaphosa’s position remains secure even if the impeachment process eventually reaches a parliamentary vote on his removal. The ANC retains sufficient parliamentary strength to protect him. What remains uncertain is how the ANC’s coalition partners would vote in any eventual impeachment proceeding, an unpredictability that adds a long-term variable to the political calculus.

The interim interdict does not resolve the underlying questions about Ramaphosa’s conduct. It creates a procedural pause, allowing the judiciary to examine whether the 2022 report that triggered the impeachment process was itself legally sound. That layered approach means the political and reputational consequences of Farmgate will continue playing out across multiple institutional venues, with no clear endpoint yet in sight.
