These Terms of Use ("Terms") govern your access to and use of this website, its subdomains, and related online services (collectively, the "Site"). By using the Site you accept these Terms in full. If you do not agree, please discontinue use immediately.

1. Acceptance of Terms

The Site provides news, analysis and commentary focused on capital markets, public policy and business in South Africa and the African region. Use of the Site is subject to these Terms and any additional rules, notices, or policies posted on the Site. We may require registration for certain services; when you register you agree to provide accurate information and keep it updated.

When using the Site you agree not to: - Post or transmit material that is unlawful, defamatory, obscene, abusive, hateful, or that promotes illegal activity. - Impersonate any person or entity, or misrepresent your affiliation with any person or entity. - Upload viruses, malware or any code intended to disrupt or damage the Site or other users’ devices. - Circumvent technological measures or restrictions on the Site, scrape or harvest data, or engage in automated access without our prior written consent. - Infringe the intellectual property, privacy, publicity, or other rights of third parties.

We reserve the right to remove, edit or refuse any content and to restrict, suspend or terminate access to the Site for any reason, including for violations of these Terms or behaviour that we reasonably deem harmful to the Site or its users.

4. Moderation and Notices

In no event will Africa Capital Watch be liable for any indirect, incidental, special, consequential or punitive damages arising out of or in connection with your use of the Site, even if advised of the possibility of such damages. Our aggregate liability to you for any claim arising out of or relating to these Terms or the Site shall be limited to the amount you have paid to us in the twelve (12) months preceding the claim. If you have paid nothing, our liability shall be limited to a nominal amount of ZAR 100. Some jurisdictions do not allow limitations on certain damages; where such exclusions apply, our liability will be limited to the fullest extent permitted by law.

7. Governing Law and Disputes

These Terms and any dispute arising out of or related to the Site are governed by the laws of the Republic of South Africa, without regard to conflict of laws principles. You agree to submit to the non-exclusive jurisdiction of the South African courts for resolution of disputes.

8. Changes to These Terms

We may modify or update these Terms from time to time. When changes are material we will post notice on the Site or otherwise inform registered users. Continued use of the Site after changes constitutes acceptance of the revised Terms.

9. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force. Failure to enforce any right does not waive that right.
